Asbestos-related Industrial Ailments Exempted from UK Government’s ‘No Win No Fee’ Changes

No Win No FeeAfter great campaign pressure, the UK government has finally declared that the victims seeking compensation for asbestos-related ailments will be let off the proposed reforms to the no-win no-fee rules. The new changes will prevent the no win no fee solicitors from claiming their payments from the losing side and receive a quarter of their client’s total compensation as their fees. Jonathan Djanogly, the justice minister, stated that the government proposals regarding the changes in no win no fee arrangement would be reviewed thoroughly.

The symptoms of mesothelioma can take years to show up. Asbestos-related illnesses commonly affect the factory workers and plumbers. Because of the great severity of asbestos-related diseases, the campaigners demanded that the sufferers of mesothelioma should be freed from the changes. Djanogly confirmed that he had evaluated the special case of the mesothelioma and promised to impose a delay in effecting the changes. He promised that the government would be committed to consider effective means to track the former employer’s insurers and help the victims and their solicitors.

Djanogly asserted that the UK government is working closely with insurance companies on this compelling issue with the aim to announce the final changes by this 2012 July. The Head of Industrial Disease at Simpson Millar LLP, Emma Costin, appreciated the campaigners for their tireless endeavors in convincing the obstinate government.

Though Emma Costin has appreciated the announcement, she said that the justice minister’s declaration has become a matter of great concern since he confirmed that the reprieve will not be permanent and further declarations are expected by July.

The opposition party has gladly accepted the proposed changes in no win no fee rules. The shadow justice secretary, Sadiq Khan, said that the sufferers of mesothelioma and other asbestos-related ailments are not bound to offer a part of the money received as industrial disease claims to their no win no fee solicitors. It is the wrongdoers who should pay for the successful litigation.
